Congratulations to Associate Regan Leavitt on Her Recent Trial Victory!

        The Plaintiff filed suit against his insurance company for uninsured motorist benefits, alleging significant injuries and damages in a motor vehicle accident allegedly caused by a ghost vehicle.  The Plaintiff claimed that the ghost vehicle first collided with Plaintiff’s motor vehicle in the rear which, in turn, pushed Plaintiff’s vehicle into the vehicle in front of him, causing his vehicle to flip and land on its hood.  Further, Plaintiff claimed that the ghost vehicle fled the scene of the accident, and he was unable to retain any of the vehicle’s information.

        Throughout discovery, Regan unearthed a series of inconsistencies in the Plaintiff’s case including, but not limited to, conflicting statements regarding the mechanism of injury and/or point of contact between the vehicles, the availability of independent witnesses, and the existence of the subject “ghost vehicle.” Regan skillfully cross-examined the Plaintiff to highlight the numerous discrepancies with his testimony and deconstructed the Plaintiff’s narrative, despite not having a witness of her own to contradict the Plaintiff’s version of events.

        Ultimately, this matter proceeded as a bench trial before the Circuit Court, and the Court entered judgment in favor of the Defendant. This win emphasizes how a well-prepared defense and considerable knowledge of the facts and/or previous deposition testimony can effectively counter a Plaintiff’s claim for injuries even without a defense witness.
